Terms of Service

By accessing or using WaBlast ("the Service"), operated by Graphicy Media (Udyam Registered, India), you agree to be bound by these Terms of Service and all applicable laws and regulations.

If you do not agree with any of these terms, you are prohibited from using or accessing this service. These terms apply to all users, including businesses and individuals.

WaBlast is a WhatsApp Business messaging platform that allows registered businesses to:

• Connect their WhatsApp Business Account via Meta's official Embedded Signup
• Create and manage Meta-approved message templates
• Import and manage contact lists for bulk messaging campaigns
• Schedule and send bulk WhatsApp messages using approved templates
• Track campaign delivery status and message logs
• Set up automated replies for incoming messages

WaBlast operates as a Tech Provider using Meta's official WhatsApp Business Cloud API. All messaging goes through Meta's infrastructure.

To use WaBlast, you must:

• Be at least 18 years of age
• Be a registered business or authorized representative of one
• Have a valid WhatsApp Business Account approved by Meta
• Comply with Meta's WhatsApp Business Policy and Terms of Service
• Not be located in a country under applicable sanctions or export restrictions

WaBlast is intended for business use only and is not available for personal messaging purposes.

You are responsible for maintaining the security of your WaBlast account:

• Keep your login credentials confidential and do not share your account
• Immediately notify us of any unauthorized use of your account
• You are responsible for all activity that occurs under your account
• Ensure your WhatsApp Business Account credentials are kept secure
• Do not attempt to access another user's account or data

Graphicy Media is not liable for any loss or damage arising from your failure to maintain account security.

You agree to use WaBlast only for lawful purposes. You must NOT use the service to:

• Send spam, unsolicited messages, or messages to contacts who have not opted in
• Send illegal, harmful, threatening, abusive, or fraudulent content
• Violate Meta's WhatsApp Business Policy or Messaging Guidelines
• Impersonate any person or organization
• Distribute malware, phishing links, or any malicious content
• Send messages that violate any applicable law or regulation in India or internationally
• Resell or sublicense access to WaBlast without written permission
• Reverse engineer, decompile, or attempt to extract source code

As a user of WaBlast, you are solely responsible for ensuring that all your WhatsApp messaging activities comply with:

• Meta's WhatsApp Business Policy
• Meta's Platform Terms
• WhatsApp's opt-in requirements — all recipients must have explicitly consented to receive messages
• Applicable Indian telecommunications laws and the TRAI regulations

Graphicy Media is not responsible for any actions taken by Meta against your WhatsApp Business Account due to policy violations on your part.

WaBlast operates on a credit-based system:

• Credits are purchased in advance and deducted per message sent
• New accounts receive complimentary credits upon registration
• Credits are non-refundable once purchased, except in cases of technical error on our part
• Unused credits do not expire unless your account is terminated for violation of these terms
• Prices are in Indian Rupees (INR) and inclusive of applicable taxes
• We reserve the right to change credit pricing with 30 days notice

All content, features, and functionality of WaBlast — including but not limited to software, text, graphics, logos, and design — are the exclusive property of Graphicy Media and are protected by applicable intellectual property laws.

• You may not copy, modify, distribute, or create derivative works without written permission
• Your data (contacts, templates, campaigns) remains your property
• You grant Graphicy Media a limited license to process your data solely to provide the service
• The WaBlast name, logo, and branding are trademarks of Graphicy Media

WaBlast is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

• We do not guarantee uninterrupted or error-free service
• Message delivery depends on Meta's WhatsApp infrastructure, which is outside our control
• Template approval decisions are made solely by Meta and we cannot guarantee approval
• We are not responsible for downtime caused by Meta's API or third-party services

To the maximum extent permitted by applicable Indian law, Graphicy Media shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from unauthorized access to your account
• Actions taken by Meta against your WhatsApp Business Account
• Message delivery failures or delays due to Meta's infrastructure

Our total liability to you for any claim arising out of or related to these terms shall not exceed the amount you paid to Graphicy Media in the 3 months preceding the claim.

Either party may terminate the service relationship:

• You may delete your account at any time by contacting graphicyin@gmail.com
• We may suspend or terminate your account immediately for violation of these terms
• We may terminate accounts that have been inactive for more than 12 months with prior notice
• Upon termination, your data will be deleted within 30 days
• Unused credits are non-refundable upon voluntary account deletion

Termination does not relieve you of any obligations or liabilities incurred prior to termination.

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

• Any disputes shall be subject to the exclusive jurisdiction of the courts of India
• We encourage resolving disputes amicably by contacting us first at graphicyin@gmail.com
• If informal resolution fails, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996
